Any citation using the General Duty Clause must meet specific criteria, which are summarized starting on Page 4-14 of the FOM. Review the criteria and discuss a situation that you believe could be cited by an OSHA compliance officer using the General Duty Clause. Provide sound reasoning for your answer, including a discussion of why the situation you chose would be cited using the General Duty Clause and not some specific OSHA regulation.

OSHA requires the employer to post a hard copy of several documents related to citations and penalties in the area where the violation occurred or, if that is not feasible, in an area where affected employees will readily see the notices. Do you believe, in the modern electronic age, the use of a hard copy is the most effective method of displaying the information? Discuss at least one additional method of displaying the information and why you believe it would be a more effective method. Alternately, you may defend the use of a hard copy posted in the work area and state why you believe that method would be more effective.

You receive a document (linked below) by certified mail. After reading the document, prepare a response that summarizes the approach you would take to the citations and penalties that have been proposed. Be sure to include the following in your response:

• steps you are required to take,

• contacts you would make, and
• documentation necessary to respond to the citations and penalties.

Your response must be a minimum of two pages in length, using at least one reference. All sources must be cited, and a reference provide using APA style.

Question 4

Based on the Citation and Notification of Penalty letter you received in Unit 3, prepare a document that summarizes at least five actions you would take as soon as possible after you reviewed the letter. For each of the actions, you must state the following:

• the exact action,
• why you believe the action is required for the citations and penalties,
• how you believe the action will assist in responding to the citations and penalties, and
• resources you would use to accomplish the action.

You must support your actions with reliable sources. Your response must be a minimum of two pages in length, using at least one reference. All sources must be cited, and a reference must be provided using APA style.
